⏹️ Colorado Privacy Act Biometric Data Amendment Takes Effect July 1, 2025
Colorado's enhanced biometric data protections under House Bill 24-1130 become effective July 1, 2025, expanding the existing Colorado Privacy Act with stricter requirements for processing biometric identifiers. Companies already subject to the Colorado Privacy Act — those with annual revenues exceeding $25 million and processing personal data of at least 100,000 Colorado consumers (or deriving revenue from selling personal data of 25,000+ consumers) must now implement additional safeguards specifically for biometric data collection and processing. Businesses must update their privacy notices, consent mechanisms, and data handling procedures to address biometric data separately from other personal information categories, with non-compliance potentially resulting in penalties up to $20,000 per violation under the existing CPA enforcement framework.
⏹️ DOL Suspends Enforcement of 2024 Independent Contractor Rule Effective May 1, 2025
The U.S. Department of Labor's revised independent contractor rule under the Fair Labor Standards Act takes effect August 1, 2025, implementing a six-factor economic reality test for worker classification. Employers must evaluate workers based on investment requirements, control over work performance, permanence of relationship, integral role in business, skill and initiative required, and opportunity for profit or loss. The rule eliminates previous "core factors" weighting, requiring holistic analysis of all factors to determine proper classification.
